The Investment Company Act of 1940 is an act of Congress that was passed as a set of laws which regulate the registration and activities of an investment company. This regulation is policed by the Securities and Exchange Commission.

The passing of the act followed the creation of the Securities Act of 1933 and the Securities Exchange Act of 1934 which were put into play to regulate the securities industry in the interest of the public.
