Ian McGinley was appointed director of enforcement at the U.S. CFTC in February of 2023. In this role, McGinley oversees a team of 120 civil-enforcement attorneys who investigate fraud and misconduct in futures markets tied to energy and agricultural commodities, as well as digital assets that qualify as commodities.[1]

McGinley was previously a partner at Akin Gump Strauss Hauer & Feld LLP, starting in September 2021. He resigned from that post in order to join the CFTC.[2]

Background[edit]

McGinley spent more than a decade as a prosecutor at the United States Attorney’s Office for the Southern District of New York (SDNY), where he co-led the Complex Frauds and Cyber Crime Unit. He was also a senior member of the Securities and Commodities Task Force, which plays a leading role nationally in the prosecution of white-collar crimes.

At SDNY, McGinley led criminal prosecutions involving a wide range of white-collar crimes, including market manipulation, insider trading, cryptocurrency fraud, bank fraud, and cybercrime. When the Covid-19 pandemic began, he was appointed SDNY’s coronavirus fraud coordinator to oversee all pandemic related fraud cases.

McGinley’s time as a federal prosecutor included filing criminal charges against the leaders of OneCoin, a multibillion-dollar cryptocurrency fraud co-founded by Ruja Ignatova, who is on the FBI's Ten Most Wanted Fugitives list.

Earlier at SDNY, he served as the chief of the Narcotics Unit. He also investigated and tried cases involving sanctions violations and international terrorism, including the trial conviction of Abu Hamza al-Masri, a notorious terrorist leader who supported al-Qaeda. During his time at SDNY, McGinley received the Attorney General’s Distinguished Service Award, the True American Hero Award, and the Counterintelligence Operations Award. He was named Federal Prosecutor of the Year in 2015.[3]

McGinley received a J.D. from New York University School of Law. He has an M.P.P. from the Harvard Kennedy School and an M.Sc. with merit from the London School of Economics and Political Science. He received a B.A., magna cum laude, from Georgetown University.[4]
